The four year marriage of actress Jodie Turner-Smith, 38, and Doctor Odyssey star, Joshua Jackson, 46, is finally over after a long court battle. The Jodie Turner-Smith and Joshua Jackson divorce is finalized, but, their custody battle for their daughter rages on.
According to People Magazine, the pair briefly settled the issue last year but nothing has been set in stone.
Turner-Smith said that she and Jackson “participated in a full-day mediation” with a judge in May 2024 and resolved their “temporary custody issues” for their daughter’s 2024-25 school year. Following the judge’s decision, both Turner-Smith and Jackson later entered “into a Stipulation and Order to resolve the issue of the selection of their daughter’s school,” with Turner-Smith declaring that it authorized her “to make the final decision” regarding their daughter’s education.”
Turner-Smith accused Jackson of not following the order
“As such, I have the clear authority to make the school selection in Juno’s best interest, and Josh is refusing to adhere to the terms of the Stipulation and Order and is depriving me of the right to select the school.”
Jackson’s legal team challenged the order last month objecting to the child’s enrollment and concerns about the drive time.
Turner-Smith is asking for $75,000 in attorney fees.
Since their breakup, Turner-Smith has been very open about their split and co-parenting with Jackson, which she described as “complicated” in an interview with Glamour Magazine last year.
“It’s an adjustment period for anyone when they split up with someone because you’re used to being with your child all the time,” she said. “But nobody hands you a manual. Everyone’s trying to figure it out.
“Each parent has a different life, and especially if the reason why you’re splitting up is because you have different lives, it’s only further complicated by how you’re going to coparent,” she added.
The Doctor Odyssey star says that his daughter Juno is his main priority in his life as he explained on former “Modern Family” star Jesse Tyler Ferguson’s podcast “Dinner’s on Me.”
“If I ever did anything to estrange my daughter from myself, I would be in duress,” he said. “I actually can’t conceive of it because I don’t even wanna think of the pain that that would be.”
“Regardless of how messy the divorce is, beautiful the divorce is, easy [or] hard the co-parenting is … I think this generation of dads is understanding, like ‘I need to be here. It’s gonna be hard, but this is important, and I’ve got to do this,’ ” he continued. “It’s my job – shared with my ex-wife – to do everything that we can to nurture you, cultivate you and give you all the tools that you need in life.”
Back in December of last year, Turner Smith said that Jackson had not paid her child support in a year and demanded that he give her back child support for her and her daughter.
She also claimed in her court filing that Jackson had promised to always take care of her and their 5-year old daughter, which may explain why he is going for full custody.
