There were more than 13 million light vehicles sold in the US in 2021 and test driving a vehicle is a common part of the car buying experience. However, accidents can and do happen during test drives. So who is responsible when a test drive goes wrong? Here’s a look at liability and insurance coverage for test drive accidents in Dallas, TX.

The Test Driver’s Insurance Coverage

In Texas, anyone operating a vehicle is required to carry a minimum level of auto liability insurance. So, if you cause an accident during a test drive, your own auto insurance policy should cover injuries to others and damage to their property, up to your policy limits. Your insurance would also typically provide coverage if you are injured, through medical payments or personal injury protection.

However, your personal auto insurance may not apply if you do not have permission to test drive the vehicle. In addition, some insurers may exclude coverage for commercial use, such as activities relating to auto sales. Check with your insurer about the specifics of your coverage before test driving.

The Dealership’s Insurance

Reputable Texas dealerships carry what is known as garage liability insurance. This policy is designed to protect the dealership’s inventory in cases when newly purchased vehicles are involved in accidents before the new owner’s insurance takes effect.

Garage insurance also generally covers dealership-owned vehicles, including cars available for customers to test drive. So, if an accident occurs during a permitted test drive, the dealership’s garage policy should provide liability coverage. However, policy limits can vary greatly between insurers.

As a Driver, Use Caution

When taking a test drive, use extreme caution and follow all traffic laws – 52 percent of all car crash deaths in 2021 were caused by single-vehicle crashes. Make sure you have the dealership’s permission and that your license is valid. Inspect the vehicle before heading out and report any prior unrepaired damage or issues. Buckle up and avoid distractions while driving. Also, stick to designated test drive routes shared by the dealer. Following these simple precautions can help avoid accidents.

If you want to test higher speed capabilities or handling, only do so in safe, controlled conditions and with express permission. Reckless driving could negate available insurance protections. So, drive responsibly, for your own safety and to avoid massive liability risks.

In Case of an Accident in Dallas

Immediately stop if you are in an accident during a test drive. Take appropriate action if anyone is injured, including calling 911 if needed. Exchange information with the other driver and contact the police to file an accident report. You should also document the scene through photos and take down any witness contact details.

Be sure to promptly notify the dealership of the incident as well, after you have spoken to a personal injury lawyer specializing in auto accidents. Both your personal auto insurer and the dealership’s garage insurer will likely want information about the accident. They will investigate liability and coverage based on the specifics of what occurred.
