Sean “Diddy” Combs was arrested in September 2024, less than a year after an eye-opening lawsuit from his former girlfriend, Cassie. Diddy has been accused of running a criminal enterprise which forced women to have sex and in various locations across the country, while using employees from his company to help him run his illegal activities. Here’s a deeper dive into the Diddy charges and how much time he is facing on each charge. Sean Combs charges explained, in our break down.

Diddy RICO Charges explained
The original indictment against Sean Combs has been updated two times. He started off with 3 charges, which have since been updated to 5 charges. As with any case, there is the possibility that he may be convicted on one charge but may be found not guilty of others, so we will do our best to explain how these charges will play out in court.
There are 4 victims listed in the indictment that are all expected to testify in court, although their names have not been publicly revealed. Victim 1 is assumed to be Cassie Ventura. It’s yet to be determined who may appear in court as “Victim-2,” “Victim-3” and “Victim-4.”
Count 1: Racketeering Conspiracy
With the first count, Diddy is indicted on racketeering charges involving threats and coercion to “fulfill his sexual desires.”
Racketeering, as defined by the federal Racketeer Influenced and Corrupt Organizations Act (RICO), is a set of criminal activities engaged in by a group to repeatedly gain profit, often through methods like extortion, bribery, fraud, or threats.
Prosecutors charged that Diddy led a criminal enterprise “whose members and associates engaged in, and attempted to engage in sex trafficking, forced labor, kidnapping, arson, bribery, and obstruction of justice.”
Authorities also alleged in their complaint that he exerted control over victims by promising career opportunities, providing and threatening to withhold financial support, dictating how they looked, monitoring their health records, and controlling where they lived.
Cassie Ventura testified that Combs would use her record deal with Bad Boy to control her. She signed a 10-album record deal with Combs’ label, Bad Boy Records, but only released one album and two singles over the ten year plus period she was with the mogul.
The charge carries a maximum sentence of life in prison.
Count 2 & 3: Sex Trafficking by Force, Fraud, or Coercion
Prosecutors say that “Victim 1” was knowingly recruited, enticed, and transported by Diddy for “commercial sex acts.”
They say Diddy’s actions impacted interstate and foreign commerce through reckless threats of force.
These counts carry a maximum sentence of life in prison and a mandatory minimum sentence of 15 years in prison.
Count 4 & 5: Transportation to Engage in Prostitution
In the last count of this indictment, Combs is accused of knowingly transporting a victim across state lines with the intent to engage them in prostitution.
Prosecutors said he attempted and willfully transported female victims and sex workers for this purpose on multiple occasions. Ventura has already testified that she would engage in sexual acts with both male and female sex workers hired either by Diddy himself or someone on his staff. There is also proof that these “freak-offs” took place in multiple locations with Combs and Ventura with one male escort saying he had sexual relations with Cassie, which Combs watched.

What Is The Diddy Defense?
Combs has pleaded not guilty to all charges and vehemently denies any wrongdoing.
We know that he was offered a plea deal about a week before the trial started, which he turned down. It’s unclear what the prosecution offered Diddy, but considering that he is facing anywhere from 10 years in prison to life in prison, the plea deal could have been a gamechanger for him.
Diddy’s lead attorney is Marc Antony Agnifilo, who is no stranger to high profile cases. Diddy’s legal team also consists of Teny Geragos, Alexandra Shapiro and Brian Steel, among others.
The defense team has suggested that Diddy’s victims are all ex-girlfriends who were participating in consensual sexual acts as a adults. The defense has made it clear that they accept that their client is a domestic abuser and his a history of physical violence, but their assertion is that although the jury may not like him, or think he is a good person, he is not being charged for assault and domestic abuse. His charges are well beyond the scope of conduct of someone who commits domestic violence. Ultimately, they are claiming that the prosecution has overreached in their claims.
Even if Combs is found not guilty on all four charges, he still faces civil cases from dozens of accusers, including Dawn Richard who also accused him of sexual assault and false imprisonment. Those accusations at the very least would further take a toll on him financially.
